Scholar Commons Deposit Agreement:
I hereby grant to Santa Clara University, which includes the University Library and SCU’s agents, successors, and assigns, and all others acting with the permission of any of the foregoing, a non-exclusive right to retain, reproduce, and distribute world-wide the deposited work (“Work”) in whole or in part, in print and electronic format in any medium, including, but not limited to, audio or visual, for the purpose of inclusion in the SCU institutional repository Scholar Commons, along with my name, date, age, and location, unless I have selected the right to remain anonymous on the form.
This Agreement does not represent a transfer of copyright to SCU.
SCU may make and keep more than one copy of the Work for purposes of security, backup, preservation, and access, and may translate the Work to any medium or format for the purpose of preservation and access in the future. SCU will not alter the Work, except as allowed by this Agreement.
I represent and warrant that I have the authority to grant the rights contained in this Agreement and that the Work is my original work. I also represent and warrant that the Work does not, to the best of my knowledge, infringe upon or violate any rights of others. I further represent and warrant that I have obtained all necessary rights to permit SCU to reproduce and distribute the Work and that any third-party-owned content is clearly identified and acknowledged within the Work.
SCU may assign this Agreement in whole or in part and this Agreement shall be binding upon, and benefit, the successors and assigns of SCU. This Agreement shall be governed by the laws of the State of California, without reference to its conflict of laws principles. Exclusive jurisdiction of all disputes hereunder shall lie in the State and Federal Courts sitting in Santa Clara County, California. This Agreement constitutes the entire understanding and agreement between the parties with respect to its subject matter, and supersedes any and all prior or contemporaneous representations, understandings, and agreements whether oral or written between the parties relating to the subject matter of this Agreement.
